Terms and Conditions
This is a translation; the German version is legally binding.
§ 1Scope and Provider
These General Terms and Conditions (Terms) apply to all contracts for the purchase of licences for the software "OPLegendBot" (hereinafter "Software") concluded via the website oplegendbot.fyi (hereinafter "Website").
The provider and contracting party for the use of the Software is Jan Rehder, trading as OPLegendBot, An der Friedenskirche 15, 24941 Flensburg, email: kontakt@oplegendbot.fyi (hereinafter "we" or "us").
Our offer is directed at consumers and businesses. Deviating terms of the customer do not apply, even if we do not expressly object to them. By purchasing a licence or using the Software, you accept these Terms.
We have no affiliation with the operators or rights holders of the game "One Piece Legend" or "OPLegend" (in particular HaiTacViet Co., Ltd. and BabelTime), nor with the rights holders of "One Piece". The Software is not an official product of these companies. Trademarks and names mentioned belong to their respective owners and are used for descriptive purposes only.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns and refunds. You conclude the purchase contract for the licence with Paddle; the Paddle Buyer Terms also apply. These Terms govern the use of the Software and the licence between you and us.
§ 2Description of Services
The Software automates recurring tasks in the browser game "One Piece Legend" for your game accounts. It runs on your device; you log in to the game with your own login credentials, which never leave your device.
To use the Software you need a valid licence key and an internet connection. The validity of the licence is checked online when logging in to the game. Without a valid licence, the Software cannot log in.
A licence includes a number of account slots (1, 3 or 10). One account slot permits simultaneous use of the Software for one game account. A slot counts as occupied as long as the game account has been used within the last 7 days. You can release occupied slots early in your customer account no more than three times per calendar month.
The current scope of functions is determined by the description on the Website at the time of the order.
§ 3Ordering
The presentation of the licences on the Website does not constitute a binding offer, but an invitation to order.
On the Website, you choose the term, the number of account slots and the payment method (one-time purchase or subscription). Ordering and payment take place in Paddle's checkout, where you can check and correct your details before submitting.
The purchase contract is concluded with Paddle under the Paddle Buyer Terms. As soon as Paddle confirms the payment to us, the licence key is shown once on the Website and sent to you by email. You receive the order confirmation and the invoice from Paddle.
The language of the contract is German.
§ 4Prices and Payment
The prices stated at the time of the order apply. As the seller, Paddle charges the sales tax (VAT) applicable in your country and shows it in the checkout and on the invoice.
Payment, invoicing, subscription billing and refunds are handled by Paddle under the Paddle Buyer Terms.
One-time purchase: You pay once for the selected term (30, 90 or 365 days). The licence ends when the term expires, without the need for cancellation. You can extend it by purchasing again; the new term then follows on from the remaining one.
Subscription: The subscription begins with the selected initial term (30, 90 or 365 days) and is paid in advance at the beginning of each billing period. After the initial term has expired, it continues for an indefinite period and can then be terminated at any time with one month's notice. We will refund on a pro-rata basis any amounts already paid for the period after the termination takes effect; Paddle pays them back to the original payment method. During the initial term, termination is possible with effect from its end.
You can cancel via the button "Cancel contracts here" on the Website, in your customer account, via the link in Paddle's emails or on paddle.net, or by email to kontakt@oplegendbot.fyi.
§ 5Right of Use
For the duration of the term, you receive a simple, non-transferable and non-sublicensable right to use the Software for the agreed number of account slots.
The licence key must be treated confidentially. Passing on, selling or sharing the licence key with third parties is not permitted.
It is prohibited to circumvent the licence check, or to modify, decompile or reverse-engineer the Software, unless this is expressly permitted under §§ 69d, 69e UrhG (German Copyright Act).
You must not use the Software or the Website unlawfully or fraudulently, infringe third-party rights (in particular copyrights and trademarks), introduce malware, attack, probe or scrape our systems, or send unsolicited messages (spam) through them.
All rights to the Software, the Website and their content remain with us, unless they belong to third parties.
§ 6Availability and Dependence on the Game
(1) The Software depends on a third-party game over which we have no control. If the game operator changes the game, its interfaces or its rules, the Software may wholly or partly fail to work, temporarily or permanently. We give no guarantee of any particular availability or any particular functioning of the Software or the licence check.
We endeavour to adapt the Software within a reasonable time after changes to the game, but are not obliged to do so within any specific period.
We may change the scope of functions insofar as this is reasonable for you, in particular if the core of the service — the automated completion of game tasks — is preserved, or if a change becomes necessary due to the game or for legal reasons.
If, for reasons within our sphere or due to changes to the game, the Software is essentially unusable for you for more than 14 consecutive days, you may terminate the contract without notice. For the unused term already paid for, we will refund the pro-rata price.
§ 7Risks of Use in the Game
(1) The game operator's terms of use prohibit the use of third-party software and bots. Use of the Software may therefore result in the game operator warning, restricting, temporarily or permanently banning your game accounts, or removing game progress, items or in-game currency.
You decide yourself and on your own responsibility whether and for which game accounts you use the Software, and you bear this risk. For measures taken by the game operator — in particular bans, loss of items, in-game currency or in-game purchases — we provide no compensation, unless we are responsible for them under § 11. The refund under § 10 remains unaffected.
The Software uses game resources (e.g. gold) only in accordance with your settings. You are responsible for these settings.
§ 8Discontinuation of the Service
We may permanently discontinue the Software and the licence check. We will announce this at least 4 weeks in advance by email and on the Website.
We may discontinue without a notice period if continued operation becomes impossible or unreasonable, in particular because the game is discontinued, the game operator permanently prevents use by technical means, or legal reasons stand in the way.
All contracts end upon discontinuation. We will refund on a pro-rata basis any term already paid for but not used. There are no further claims, unless § 11 provides otherwise.
§ 9Blocking of the Licence Key
We may block a licence key if you breach § 5, or attack or attempt to circumvent the licence check or our systems. Where reasonable, we will issue a warning beforehand.
If a payment is reversed or disputed, we may block the licence key until the matter is resolved.
We may also block a licence key if fraud or security reasons require it or if you repeatedly or seriously breach these Terms.
§ 10Refunds and Right of Withdrawal
Within 14 days of purchase, we will refund the full price on request — without giving reasons and without conditions. For a subscription, this applies to every payment, 14 days from that payment in each case. You request the refund via paddle.net or by email to kontakt@oplegendbot.fyi; Paddle pays it back to your original payment method. Details: Refunds.
Your statutory rights, in particular a right of withdrawal towards Paddle as the seller under the Paddle Buyer Terms, remain unaffected. Refunds under § 6 (4) and § 8 (3) also apply after the 14 days.
§ 11Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Produkthaftungsgesetz (German Product Liability Act), and to the extent of any guarantee we have assumed.
In the event of a slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), our liability is limited to the foreseeable damage typical for the contract.
Otherwise, liability for slight negligence is excluded.
§ 12Data Protection
Information on the processing of personal data can be found in our privacy policy.
§ 13Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 14Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.
Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
